Important: RecallReady provides consumer safety information for general awareness purposes only. It is not a substitute for professional medical, legal, or regulatory advice. Always verify recall information directly with the U.S. Food and Drug Administration at fda.gov.
These Terms of Service ("Terms") govern your access to and use of the RecallReady website, mobile application, and related services (collectively, the "Service") operated by RecallReady LLC, a Georgia limited liability company ("RecallReady," "we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years of age to use the Service. By using RecallReady, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.
2. Description of Service
RecallReady aggregates and displays publicly available product recall data sourced from the U.S. Food and Drug Administration's openFDA database. The Service provides alerts and notifications for food, drug, medical device, and animal product recalls.
The Service is offered in two tiers:
- Free Tier: Limited category access, weekly digest emails, and advertising. Available at no charge.
- Full Access ($9.99/year): All product categories, household filtering, instant push notifications, and no advertising.
3. Informational Purpose Only — No Professional Advice
THE SERVICE IS FOR INFORMATIONAL PURPOSES ONLY. RecallReady does not provide medical, legal, dietary, veterinary, or regulatory compliance advice. Nothing on the Service should be construed as professional advice of any kind.
Recall data displayed on the Service is sourced directly from the openFDA public API and is provided as-is. RecallReady does not independently verify, supplement, or guarantee the accuracy, completeness, or timeliness of any recall information. For definitive recall information, always consult the FDA directly at fda.gov.
4. No Guarantee of Complete Recall Coverage
RecallReady's database is limited to recalls published through the openFDA API. Not all recalls, market withdrawals, or safety alerts may be captured. You acknowledge that:
- RecallReady is not a comprehensive source of all product safety information
- There may be delays between an FDA recall announcement and its appearance in the Service
- Recall classifications, statuses, and details may change after initial posting
- Absence of a recall notification from RecallReady does not mean a product is safe
5. User Accounts and Waitlist
When you join the RecallReady waitlist or create an account, you agree to provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@recallready.app if you suspect unauthorized access to your account.
6. Subscriptions and Billing
Full Access subscriptions are billed annually at $9.99/year. By subscribing, you authorize us to charge your payment method on a recurring annual basis until you cancel. You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. We do not offer refunds for partial subscription periods except where required by law.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Scrape, crawl, or systematically download data from the Service without written permission
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Transmit any malicious code, viruses, or disruptive data to the Service
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Use the Service to distribute spam, unsolicited communications, or commercial solicitations
- Interfere with or disrupt the integrity or performance of the Service
8. Intellectual Property
The RecallReady name, logo, design, and original content are owned by RecallReady LLC and protected by applicable intellectual property laws. Recall data sourced from the openFDA API is a U.S. government public domain dataset. You may not reproduce, distribute, or create derivative works from RecallReady's original content without prior written permission.
9. Third-Party Links and Services
The Service may contain links to third-party websites or services. RecallReady is not responsible for the content, privacy practices, or terms of any third-party site. Links do not constitute endorsement.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. RECALLREADY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RECALLREADY LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PERSONAL INJURY, PROPERTY DAMAGE, OR FINANCIAL LOSS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL RECALLREADY'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO RECALLREADY IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $10.00.
12. Indemnification
You agree to indemnify, defend, and hold harmless RecallReady LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Georgia, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Gwinnett County, Georgia. You consent to personal jurisdiction in those courts.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a new effective date. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
15. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or the integrity of the Service.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and RecallReady LLC regarding your use of the Service and supersede all prior agreements and understandings.
